Discuss Your H-1B1 Strategy

What Is the H-1B1 Visa?

H-1B1 is a specialty occupation classification for qualifying nationals of Chile and Singapore. It has its own annual allocation and should be evaluated separately from the ordinary H-1B process. The employer must obtain a certified Labor Condition Application for the proposed employment.

For a visa application abroad, H-1B1 generally does not require a prior USCIS petition approval. A change or extension of status inside the United States involves a different filing analysis.

Temporary Intent and Employment Changes

H-1B1 does not carry the same dual-intent protection as H-1B. The applicant must establish that the proposed stay is temporary. A future permanent residence plan therefore requires careful coordination with visa applications and travel; it is not an automatic bar in every case.

Before beginning work for a different employer, review the required LCA, filing and admission steps. Do not assume that ordinary H-1B portability rules apply to H-1B1.

Services for Employers and Professionals

  • Assessing the proposed position, job duties and professional qualifications.
  • Reviewing salary, worksite arrangements and the employer's LCA obligations.
  • Preparing employer support documentation and coordinating the application strategy.
  • Planning for a new position, a change of employer or continuation of employment.
  • Considering immigration history, travel plans, dependent family members and longer-term objectives.

Hiring for a Startup or Growing Business

A hiring decision should be evaluated against the company's actual operations and the proposed role. For startup employers, the consultation can address staffing plans, compensation, work locations, corporate documentation and the record needed to explain the employment opportunity. A founder's ownership interest and proposed employment require individual analysis.

H-1B1 and Long-Term Immigration Planning

Fariba Faiz can evaluate H-1B1 alongside H-1B sponsorship, PERM-based permanent residence, EB-1A and NIW. The appropriate sequence depends on the professional's qualifications, status, business goals and timing.

Prepare for Your Consultation

Provide the applicant's nationality and current immigration status, a resume, the proposed job description, salary, work location, employer information and any hiring or travel deadline. These details help focus the consultation on a workable strategy.
