Immigration planning for qualifying athletes, athletic teams and entertainment groups coming to the United States for competitions or performances.
Fariba Faiz Law Offices PC assists with evaluating P-1 classification, petitioner and engagement arrangements, evidence development and petition preparation. The firm is based in San Francisco and represents clients nationwide and internationally.
P-1A: Athletes and Athletic Teams
P-1A covers qualifying athletes and athletic teams, including internationally recognized athletes and teams and certain other qualifying athletic categories. The analysis depends on the applicant's athletic record, the applicable category and the proposed U.S. competition or activity.
A consultation can address competition results, rankings, league participation, recognition, contracts and the nature of the proposed U.S. engagement. An athletic title or a general invitation to participate does not, by itself, resolve eligibility.
P-1B: Entertainment Groups
P-1B concerns members of qualifying internationally recognized entertainment groups. The group's record, membership history and proposed performances are central to evaluating the case.
For a performer seeking to work individually, O-1 classification or another appropriate category may warrant consideration. The correct strategy depends on the individual, the group and the actual engagements.
Group Membership and Required Documentation
Ordinarily, at least 75 percent of an entertainment group's members must have had a substantial and sustained relationship with the group for at least one year. Circus personnel and certain cases involving a USCIS waiver are treated differently. The group's international recognition, applicable exceptions and membership record must be evaluated together.
The filing should address the required advisory consultation where applicable, contracts and the itinerary. USCIS petition approval is generally required before a P visa may be issued.
Petitioner, Contracts and Event Planning
A P-1 petition requires an appropriate petitioner; it is not a self-petition. A U.S. employer, U.S. agent or foreign employer through a U.S. agent may file, depending on the arrangement.
Fariba Faiz can review the petitioner structure, contracts, event itinerary, proposed activities and supporting record. Essential support personnel may require separate analysis and filings. Filing strategy should be coordinated with competition or performance dates, travel and consular processing.
Documents to Gather Before a Consultation
- Athletic resume or group biography and career history.
- Competition results, rankings, awards and significant recognition.
- Press coverage, reviews and evidence of the reputation of the athlete, team or group.
- Proposed U.S. contracts, invitations, itinerary, venues and event dates.
- Petitioner, employer, promoter or agent information.
- For an entertainment group, membership and performance history.
- Current immigration documents, prior petitions and relevant deadlines.
P-1, O-1 and Long-Term Immigration Strategy
The firm can compare P-1 with O-1 extraordinary ability and evaluate whether a separate EB-1A permanent residence strategy merits further review. Eligibility for one classification does not establish eligibility for another.
Discuss Your Competition or Performance Plans
A consultation provides an opportunity to evaluate the proposed engagement, identify the most relevant category and determine what additional evidence is needed before preparing a petition.
