An employer considering an Australian, Chilean, or Singaporean professional should evaluate whether E-3 or H-1B1 classification fits the proposed position. These classifications have separate annual allocations and are distinct from the ordinary H-1B cap process. Nationality creates an option to investigate; the position and applicant must still qualify.
E-3 applies to qualifying Australian nationals. H-1B1 applies to qualifying nationals of Chile and Singapore. Both involve specialty occupation employment and a certified Labor Condition Application addressing the proposed employment.
Assess the Role and Candidate Together
The employer should identify the actual duties, degree requirements, salary, and worksite. The professional's education or equivalent qualifications must support the role, and licensing requirements must be addressed where applicable. A technical-sounding title alone does not establish eligibility.
A startup can begin by gathering its business description, position details, and compensation arrangements. Counsel can then identify the records needed for the chosen route and the facts that require closer review.
Choose the Route Before Setting the Start Date
A visa application abroad and a request to change status inside the United States follow different procedures. An initial consular application generally does not require the same prior USCIS petition approval used for an ordinary H-1B visa. The applicant's current status, travel plans, and hiring schedule should guide the analysis.
Employment changes need their own review. Employers should not assume the H-1B rule permitting certain workers to start after petition filing also applies to E-3 or H-1B1. A new offer and LCA do not, by themselves, establish that the professional may begin the new employment.
Coordinate Longer-Term Plans
Temporary-intent requirements deserve attention when permanent residence is contemplated. H-1B1 does not have the same dual-intent protection as H-1B; E-3 applicants must satisfy the applicable intent requirement. Travel and green card planning should be coordinated with the nonimmigrant strategy.
For an initial assessment, provide the professional's nationality, resume, immigration status, proposed job description, salary, work location, and desired start date.
